Purpose and acceptance

These terms of use (the “Terms”) govern access to Carvoh and the use of its features by visitors, private individuals and professional users.

Creating an account requires acceptance of these Terms. The privacy policy and cookie policy separately explain data processing and choices relating to trackers.

No paid Carvoh service, subscription or paid option can be subscribed to on the effective date of these Terms. These Terms do not constitute terms and conditions of sale.

Carvoh's role

Carvoh provides a technical space for publishing, searching and connecting users. Listings are published by their authors; Carvoh is not a party to any contract that may be concluded between an advertiser and an interested party.

An offer, acceptance of an offer or rental request on Carvoh facilitates a negotiation or availability reservation. It does not constitute collection by Carvoh, transfer of ownership, or a Carvoh guarantee regarding the vehicle or performance of an agreement between users.

Each user independently verifies the identity of their contracting party, the vehicle, documents, price, insurance, handover conditions and any relevant information before concluding outside Carvoh.

Account and security

• Provide accurate, up-to-date information and do not impersonate a third party.
• Keep login credentials confidential and promptly report any unauthorised use of the account.
• Do not create multiple accounts to circumvent a restriction, suspension or moderation measure.
• Use the account for its holder or, for a professional account, for the authorised organisation.

Publishing listings

The advertiser is solely responsible for the lawfulness, accuracy and currency of the information, photos, media and documents they publish. They must hold all necessary rights and comply with the rules applicable to their activity.

It is prohibited to publish, in particular, misleading, fraudulent, illegal or discriminatory content, content infringing a third party's rights, containing personal data without a valid basis, or relating to a vehicle whose marketing is prohibited.

Private individuals publish listings subject to review before publication. Professionals whose profile has been verified may benefit from direct publication. This process does not constitute a guarantee of compliance, accuracy or availability.

Moderation and reports

Carvoh’s moderation team reserves the right to delete a listing, delete an account or withdraw a partnership where it deems this necessary.

Carvoh may review listings and reports, request information, limit the visibility of content, remove it, refuse its publication, restrict an account or suspend it where there is a reason relating in particular to these Terms, the law, security or the prevention of abuse.

Any decision to remove a listing or restrict its visibility based on its unlawful nature or incompatibility with these Terms is subject to a statement of reasons sent to the user concerned. It specifies the action taken, the facts or circumstances reviewed, the applicable basis, any use of automated means and the available appeal procedures.

Carvoh may limit the information provided in this statement only where a legal obligation prohibits it or where its disclosure would compromise an investigation, the prevention of offences or the security of the service, within the limits provided by applicable rules.

A user contesting a decision may write to contact@carvoh.com, specifying their account, the decision concerned and any useful supporting information.

Ranking and promotion

In results using relevance sorting, listings are mainly ranked according to their completeness score and then their publication date.

Listings promoted on the home page are manually selected by Carvoh. No paid promotion is active on the effective date of these Terms.

Professional users

A professional user must provide accurate business information and keep it up to date. They remain responsible for their obligations towards consumers, including pre-contractual information and identification applicable to their activity.

For a professional using Carvoh's public interface to offer vehicles to consumers, these Terms govern the intermediary relationship between Carvoh and that professional. Acceptance of the Terms when creating the account constitutes expression of agreement on this durable medium.

Under these Terms, Carvoh does not impose any restriction on a professional wishing to offer the same vehicle elsewhere under different conditions. No ancillary service or preferential treatment in return for payment is active.

Processing differs according to account status: private individuals' listings are subject to review before publication; verified professionals' listings may be published directly. Home page promotions are manually selected. The main ranking parameters are described in the “Ranking and promotion” section.

Carvoh and the professional have access to the data that the professional provides in their account and listings. Other activity data are processed in accordance with the privacy policy; Carvoh does not make access to the professional's data available to third parties outside the features, recipients and legal obligations described in that policy.

Changes, restrictions and professional data

Where an amendment to these Terms concerns professionals using Carvoh's public interface, Carvoh communicates the amended text on a durable medium with reasonable notice and, where Regulation (EU) 2019/1150 requires it, at least fifteen days before it takes effect, except where legally permitted otherwise.

Any restriction, suspension or termination of the service to a professional is reasoned on a durable medium, with the facts and applicable clause, except where legally permitted otherwise. The possible grounds are those described in the “Moderation and reports” section.

A professional may request clarification on access to their data or contest a measure by writing to contact@carvoh.com. Carvoh processes this request in accordance with applicable obligations and any exemptions from which it benefits as a micro or small enterprise.

Availability and liability

Carvoh uses reasonable efforts to provide the platform, but does not guarantee uninterrupted availability or the absence of errors, malicious elements or inaccurate content published by users.

To the extent permitted by law, Carvoh is not liable for negotiations, contracts, payments, handovers, disputes, damages or defaults occurring between users. Nothing in these Terms limits a consumer's mandatory rights or liability that cannot legally be excluded.

Changes and end of use

Carvoh may change the platform or the Terms for legal, security, technical or service-related reasons. Material changes requiring renewed acceptance will be presented before they take effect.

The user may stop using Carvoh and request deletion of their account in accordance with the arrangements described in the privacy policy. Carvoh may terminate access under the conditions provided in the “Moderation and reports” section.

Applicable law and contact

These Terms are governed by Belgian law, without prejudice to mandatory provisions applicable to the user. The competent courts are determined in accordance with applicable mandatory rules.
