Terms of Use

Article 1 — Purpose

These General Terms of Use (hereinafter "Terms") govern access to and use of the Carvoh waitlist website (hereinafter the "Site"). Carvoh is a company registered under BCE number 1018 823 563, with its registered office at Rue de la Station 8, 6040 Jumet (Belgium).

The Site allows visitors to pre-register on the waitlist in order to receive information about the launch of the Carvoh vehicle marketplace and, where applicable, early access benefits.

By accessing the Site or submitting a waitlist registration, you acknowledge that you have read, understood, and accepted these Terms without reservation. Carvoh reserves the right to modify these Terms at any time; the applicable version is the one in force at the time of your use of the Site.

Article 2 — Definitions

• "User": any natural person accessing the Site or submitting a waitlist registration.
• "Waitlist": the pre-launch registration list for the Carvoh service.
• "Carvoh": the vehicle marketplace project.
• "Services": the functionalities offered via the Site, including waitlist registration, email verification, and related communications.

Article 3 — Acceptance

Use of the Site implies full and complete acceptance of these Terms. If you do not accept these Terms, you must not use the Site or submit a registration.

Article 4 — Eligibility

The Site is intended for users aged at least 18 years with full legal capacity, or the legal representative of a minor where applicable under mandatory law.

By registering, you represent that the information provided is accurate, complete, and up to date.

Article 5 — Waitlist registration

To join the waitlist, you must provide a valid email address and complete the registration form. An email verification step may be required to confirm your registration.

Registration on the waitlist does not constitute a contract for the purchase or sale of vehicles and does not guarantee access to Carvoh on a specific date or under specific conditions.

Carvoh may refuse, suspend, or remove a registration in case of inaccurate information, abusive behaviour, violation of these Terms, or technical or security requirements.

One verified registration per person or device may be permitted; additional attempts may be blocked to prevent abuse.

Article 6 — Communications

By joining the waitlist, you agree to receive transactional emails relating to your registration (verification, confirmation).

Where you have given your consent or where permitted by applicable law, we may also send you information about the Carvoh launch, product updates, or commercial communications. You may withdraw your consent or unsubscribe at any time using the link provided in our emails or by contacting contact@carvoh.com.

Article 7 — Acceptable use

You agree to use the Site lawfully and in good faith. The following are prohibited in particular:

• Providing false, misleading, or third-party information without authorisation.
• Attempting to bypass security, anti-spam, or rate-limiting measures.
• Using automated means (bots, scripts) to submit registrations without authorisation.
• Any action that may disrupt, damage, or impair the Site or the experience of other users.
• Any use contrary to applicable law, including regulations on privacy and electronic communications.

Article 8 — Intellectual property

All elements of the Site, including texts, graphics, logos, trademarks (including "Carvoh"), images, software, and databases, remain the exclusive property of Carvoh or its licensors.

Any reproduction, representation, modification, or exploitation without prior written authorisation from Carvoh is strictly prohibited and may result in civil and/or criminal proceedings.

Article 9 — Personal data

Carvoh processes personal data in accordance with its Privacy Policy and the GDPR. Data required for waitlist registration, verification, security, and communications may be processed as described in the Privacy Policy.

Article 10 — Availability and modifications

Carvoh endeavours to keep the Site accessible but does not guarantee uninterrupted or error-free availability. The Site, its content, and the waitlist may be modified, suspended, or discontinued at any time, temporarily or permanently, without prior notice.

Features described on the Site are indicative and may evolve before the commercial launch of Carvoh.

Article 11 — Liability

Carvoh's obligations in providing the Site and waitlist are obligations of means within the meaning of Belgian law.

To the fullest extent permitted by mandatory law, Carvoh shall not be liable for indirect, incidental, or consequential damages, including loss of data, loss of opportunity, or business interruption.

Carvoh's liability, where established, is limited to direct, proven damage and may not exceed, where applicable, the amount of any consideration paid by the User for the Services (which is nil for the free waitlist).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under mandatory consumer protection rules.

Article 12 — Force majeure

Carvoh shall not be liable for delays or failures resulting from events beyond its reasonable control, including natural disasters, network outages, cyberattacks, or failures of third-party providers.

Article 13 — Links to third-party sites

The Site may contain links to third-party websites. Carvoh has no control over these sites and declines all responsibility for their content or privacy practices.

Article 14 — Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Article 15 — Applicable law and jurisdiction

These Terms are governed by Belgian law.

Consumers may use the Consumer Mediation Service (https://www.mediationconsommateur.be) where applicable.

Any dispute shall be submitted to the competent courts of the judicial district of Charleroi, without prejudice to mandatory provisions granting jurisdiction to the courts of the consumer's domicile.
